These Terms and Conditions relate to the Halifax Credit Checker services and use of the halifaxcreditchecker.co.uk website. The Halifax Credit Checker services are described in paragraph 4.

‘Noddle’ is a trading name of Callcredit Consumer Limited. Callcredit Consumer Limited operates this website and will be providing the Halifax Credit Checker services to you. Our company is Callcredit Consumer Limited, our company number is 7891157 and our registered office is at One Park Lane, Leeds, West Yorkshire, LS3 1EP.

In these terms and conditions, "we", "us", and "our" refers to Callcredit Consumer Limited, and "you" and "your" refers to the user of the website.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS WEBSITE AND SIGNING UP FOR THE HALIFAX CREDIT CHECKER SERVICES AS THEY CONTAIN LEGAL RIGHTS AND OBLIGATIONS

  1. Our contract with you
    1. These are the terms and conditions which apply to your use of the halifaxcreditchecker.co.uk website and are also those on which we supply the Halifax Credit Checker services to you. These terms form a contractual relationship between us and you. Bank of Scotland plc (and the Halifax) are not parties to this contract.
  2. Changes to these terms and conditions or the Halifax Credit Checker services
    1. We may change these terms and conditions or the Halifax Credit Checker services at any time. If we do this we will put the new terms and conditions or details of the changes to the Halifax Credit Checkerservices on the halifaxcreditchecker.co.uk website. The changes will take effect when they are posted on the halifaxcreditchecker.co.uk website.
    2. If you don’t want to continue to be registered on the halifaxcreditchecker.co.uk website or to continue to get the Halifax Credit Checker services then you can cancel your registration/membership by letting us know in writing by e-mail to halifaxcontact@noddle.co.uk.
  3. Registration
    1. Before you can use any Halifax Credit Checker services you must apply to use them. Part of this process is registering on the halifaxcreditchecker.co.uk website.
    2. After we have received your application for the Halifax Credit Checker services we will review it and let you know as soon as we can whether you have been accepted as a user of the Halifax Credit Checker services. Please note that not everyone that applies for the Halifax Credit Checker services will be accepted as a user. If you have been accepted as a user of the Halifax Credit Checker services, we will inform you if we are only able to provide you with the Noddle Credit Builder service, as described in paragraph 4.1 below.
    3. We do not have to notify you why you have not been accepted but one reason for this may be that, at the time you make your application, we may have been unable to match your personal details to the correct credit report. We are constantly seeking to improve our matching service.
    4. You may only register for the halifaxcreditchecker.co.uk website and use the Halifax Credit Checker services if you (i) have an eligible Halifax financial product, (ii) have been invited to register directly by Halifax, (iii) live in the UK, and (iv) are over 18 years of age. By registering on the halifaxcreditchecker.co.uk website and making the application to use the Halifax Credit Checker services you confirm that you meet these requirements.
    5. You may only use and access the Halifax Credit Checker services on your own behalf and not on behalf of anyone else. You should be aware that you cannot order credit information about anyone else from this website.
    6. Once we have received your application for the Halifax Credit Checker services we will send you an automated acknowledgement. This is purely for acknowledgement purposes and is not an agreement from us to provide you with the Halifax Credit Checker services or any other service.
  4. Halifax Credit Checker services

    PLEASE READ THIS PARAGRAPH CAREFULLY AS IT EXPLAINS WHAT THE HALIFAX CREDIT CHECKER SERVICES ARE AND WHAT EXCLUSIONS APPLY

    1. Once we accept your application for the Halifax Credit Checker services, we agree to provide the following services to you for free under these terms and conditions:

        Basic Noddle services

      1. Credit Report

        We will provide a credit report to you online. The credit report will be updated monthly. You will also receive a monthly email and a fortnightly newsletter as part of this service.

      2. Credit Rating

        An assessment of your credit rating will be available to you online. This rating will be based on your history of borrowing and repayment.

      3. Noddle Improve services

      4. We will provide your credit score to you. Your credit score is an indicator of how good your credit history and likelihood of getting credit is. This will be made available to you online and will be updated monthly.

      5. In addition to providing your credit score, we will also identify the key things which are impacting on your credit score and provide suggestions as to actions that you may wish to take to improve this. Please note that these are simply suggestions and not specifically tailored and detailed advice. In addition, we cannot guarantee that if you take the actions that we suggest your credit score will be improved. Also you should be aware that it will take time for any action taken to impact upon your credit score.

      6. Noddle Credit Builder Service

      7. We will not be able to provide you with the Basic Noddle services or the Noddle Improve services if there is insufficient credit report information held in our credit reference database to enable us to produce a credit report or credit score for you. However, we will provide you with information about credit reports and credit scores and about ways in which you may be able to increase your credit report information held in our credit reference database. Please note that this information simply provides suggestions and is not specifically tailored and detailed advice. In addition, we cannot guarantee that if you take the actions that we suggest your credit report information will be increased. Also you should be aware that it will take time for any action taken to impact upon your credit report.

      8. In addition, we will review your credit report information held in our credit reference database from time to time and will inform you by email if we determine that there is, in our opinion, sufficient credit report information held in our credit reference database to enable us to provide you with the Basic Noddle services and the Noddle Improve services. We will then send you details of how to apply for the Basic Noddle services and the Noddle Improve services. If you apply for the Basic Noddle services and the Noddle Improve services (and we accept your application), we will provide you with the Basic Noddle services and the Noddle Improve services on these terms and conditions and the Noddle Credit Builder service shall cease. We will provide you with details of how to access Basic Noddle services and the Noddle Improve services by email.

    2. Additional services

    3. If you have been accepted as a user of the basic Noddle services and the Noddle Improve services, you may also apply for us to provide you with any of the following additional services:
      1. Noddle Alerts, as described in paragraph 4.4 below;
      2. Noddle Web Watch, as described in paragraph 4.5 below.
      Please note that you will not be able to apply for Noddle Alerts or Noddle Web Watch if you are only receiving the Noddle Credit Builder service.
    4. If you apply for any of these additional services then, as part of the application process, we will ask you to pay the annual fee for those services. You must pay this fee by credit or debit card. The current annual fee is set out in the application form when you apply to register for the additional services. If your application to register for the additional services is successful, then your payment for your annual fee will be deducted from your credit or debit card automatically.
    5. Noddle Alerts services

    6. If you have been accepted as a user of the Noddle Alerts services, we agree to provide the following additional services to you for the duration of your subscription to those services.
      1. If there are any alerts on your file, we will send a daily email to the email address you specified when you registered for the basic service. It is your responsibility to ensure the email address we hold for you is up to date. The email will contain details of any alerts that have been triggered on your credit report in the previous day. If there have been no alerts triggered then we will not send you an email.
      2. On receiving the email you will be able to log in to your account to obtain further detail of the alert. On logging in to your account you will automatically be issued with an up to date credit report.
      3. In the event that you are not happy with the content of the email report or your up to date credit report you should contact us using the online disputes process as set out in the Noddle Alerts section of the noddle.co.uk website.
      4. Noddle Alerts is a notification only service. We are not responsible for any loss you suffer if we deliver an alert to you and you do not review that alert and notify us if you believe the information is incorrect.
      5. You should not rely solely on the Noddle Alerts service to ensure that your credit report is up to date. It is your responsibility to regularly check your credit report to ensure that the information recorded in it is accurate and up to date.
    7. Noddle Web Watch services

    8. If you have been accepted as a user of the Noddle Web Watch services, we agree to provide the following additional services to you for the duration of your subscription to those services.
      1. Noddle Web Watch is a service provided by CSIdentity Corporation (CSID) and Mergermarket Limited (C6). If we receive details from CSID or C6 that your personal data is being traded or being sold fraudulently on the Internet, chat rooms, bulletin boards and file sharing sites, we will send you an email to the email address you specified when you registered for the basic services. It is your responsibility to ensure the email address we hold for you is up to date. The email will contain details of any Noddle Web Watch alerts that we have received from CSID or C6. If there have been no alerts triggered then we will not send you an email. On receiving the email you will be able to log in to your account to obtain further detail of the Noddle Web Watch alert.
      2. Noddle Web Watch is a notification only service. We are not responsible for any loss you suffer if we deliver a Noddle Web Watch alert to you and you do not review that Noddle Web Watch alert and take appropriate action in relation to such alert.
      3. You should not rely solely on the Noddle Web Watch services to ensure that your personal data is not being used or disclosed unlawfully. Please note that the Noddle Web Watch services do not replace your responsibility to regularly check your credit report to ensure that the information recorded in it is accurate and up to date.
      4. For us to be able to provide the Noddle Web Watch services to you, you will need to provide to us certain personal information (which we will request from you) that is to be monitored. It is very important that you provide accurate details to us. You agree that we can provide such information to CSID who are based in the United States of America, or to C6, in order to provide the Noddle Web Watch services to you. Whilst CSID is based in the United States of America, we have put in place appropriate protections as required to comply with the Data Protection Act 1998 in order to safeguard the transfer of your information outside the European Economic Area. You can update your information as often as you like but please be aware that it can take up to 24 hours for such monitoring to start on any new or modified information.
    9. General

    10. Once you have applied for any Halifax Credit Checker services, been accepted, and paid any applicable fees, you will be given immediate access to the relevant Halifax Credit Checker services on the halifaxcreditchecker.co.uk website and you will start to receive those services immediately. You acknowledge and request that the Halifax Credit Checker services will be provided before the expiry of the 14 day cancellation period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (but this does not affect your rights to cancellation under those regulations: please see paragraph 6.4 below).
    11. Some of the Halifax Credit Checker services may involve giving you access to items such as information or products from third parties. Since these items are provided to you by these third parties you should be aware that additional terms and conditions may be imposed by these third parties and we cannot be held responsible for these or any external content accessed through halifaxcreditchecker.co.uk or for information products, vouchers or offers provided by these third parties. Also, you are responsible for ensuring that any rates or offers made by these third parties have been applied to your chosen product before you purchase that product.
    12. For us to be able to provide the Halifax Credit Checker services to you we need to obtain your credit report information held in our credit reference database. By applying for the Halifax Credit Checker services you agree that we can use your credit report information in this way.
    13. The Halifax Credit Checker services are only available to eligible customers who live in the UK.
    14. Whilst we will try to make sure that the halifaxcreditchecker.co.uk website is available for use as much as possible we cannot guarantee its availability. You will appreciate that we need to take it down from time to time for maintenance. We will try to do this at times when we are expecting low usage but cannot guarantee that this will be the case. No software provider can fully guarantee that its website and/or content is completely virus and bug free, but you should be aware that we are committed to trying to make the Halifax Credit Checker services as virus and bug free as we can. You should therefore use virus checking software.
    15. It is important to us that the information we supply to you is as accurate as possible and we use our reasonable efforts to verify its accuracy. We cannot guarantee that it is completely accurate, however. Also, as you will appreciate some of this information comes from other businesses and sources, such as the electoral roll, insurance companies or financial institutions. Neither we, CSID, C6 nor any other third parties used to provide the Halifax Credit Checker services have any control over the content of such information and are not responsible if it turns out to be inaccurate.
    16. You will appreciate that whilst some of the Halifax Credit Checker services will provide information to you this is provided for your guidance and information only. Any businesses who carry out credit searches on you will take information from a number of sources and use their own criteria in making decisions based on it. You should not rely on the information we provide to you and we cannot be responsible or liable to you if you do rely on it or take any action based upon it.
  5. Price of the Halifax Credit Checker services
    1. The Basic Noddle services, the Noddle Improve services and the Noddle Credit Builder service will be provided to you free of charge.
    2. If you apply and are accepted for any additional services, the fees payable for those services will be charged annually. The fees are specified in the application or renewal form which you complete. If we change the fee for the additional services we will let you know by email at renewal. If you are unhappy with the increase you can choose not to renew.
  6. Duration of Halifax Credit Checker services and your right of cancellation
    1. We will provide the Basic Noddle services, the Noddle Improve services and the Noddle Credit Builder services to you for a period of 12 months from when you agree to these terms and your application is accepted by us and, after such period, until our agreement with [Halifax] comes to an end (“Initial Period”).
    2. When the Initial Period comes to an end:
      1. we will continue to provide you with the Noddle Basic services until they are cancelled by you or us. References in these terms and conditions to Halifax Credit Checker will then only be to those parts of the services. You will need to access the Basic Noddle services through noddle.co.uk;
      2. we will stop providing you with the Noddle Improve services unless you re-register for them;
      3. if you are subscribed to any of the additional services, we will continue to provide you with those services for the remaining duration of your subscription;
      4. we will stop providing the Noddle Credit Builder service.
    3. If you no longer wish to receive any Halifax Credit Checker services you may tell us to cancel them by sending a request by email to halifaxcontact@noddle.co.uk. We will administer this change within a reasonable time. If you tell us that cancellation is a matter of urgency (e.g. if you think that someone has got access to your password) we will do our best to cancel your registration immediately.
    4. If you have subscribed for any of the additional services and you tell us (in accordance with paragraph 6.3) that you wish to cancel any of those services within 14 days after the day on which we accepted your application for those services, you are entitled to a refund of the amounts you have paid for those services less an amount in proportion to the period of service you have received at the time we are informed of your decision to cancel. To meet this cancellation deadline, it is sufficient for you to send your cancellation email before the 14 day cancellation period has expired. We will pay the refund without undue delay and not later than 14 days after the day on which we are informed about your decision to cancel. The refund will be paid using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the refund.
    5. We may cancel your registration on the halifaxcreditchecker.co.uk website and cancel your receipt of any of the Halifax Credit Checker services:
      1. because of your misuse of the Halifax Credit Checker services. Misuse of the Halifax Credit Checker services means use of the Halifax Credit Checker services in a way which is not permitted by these terms and conditions or there is fraud; or
      2. if we stop providing the Halifax Credit Checker services or the halifaxcreditchecker.co.uk website. (If we are continuing to provide equivalent services through noddle.co.uk, you can continue to access your services through that site. If we withdraw those services as well, we will return the fees for the remaining part of the year for any of the additional services for which you have paid); or
      3. if any payment that you owe us is declined, rejected or reversed; or
      4. if you do not access your account on halifaxcreditchecker.co.uk for more than 3 months.
    6. We may request that you stop using the halifaxcreditchecker.co.uk website and transfer your account to noddle.co.uk (for example, following expiry or termination of our agreement with Bank of Scotland and the Halifax).
    7. Please be aware that as the functionality of the additional Noddle services relies on the provision of the basic Noddle services, if you cancel the basic Noddle services, you will no longer be able to receive the additional Noddle services either.
    8. We regret that if we withdraw part or all of the Noddle services we cannot be responsible for any costs or losses you incur.
    9. Once the Initial Period expires your ability to access the additional Noddle services that form part of the Halifax Credit Checkerservice for free will expire. Similarly, if you are subscribed to any of the additional services, your ability to access those services will expire at the end of your subscription period for those services. In each case, at the end of the relevant period we will let you know that the services are due for renewal. You may register to continue to receive these services, which may require (i) payment of the standard applicable fees for those services, and (ii) your agreement to any additional terms and conditions applicable to those services, each as detailed on our noddle.co.uk website at the time of subscribing. Access to both the remaining Halifax Credit Checker services and the additional Noddle services after the Initial Period expires will be through noddle.co.uk.
    10. Except as set out in paragraphs 6.4 and 6.5.2, you are not entitled to any refund of any amounts you have paid for any Noddle services as a result of a cancellation of those services.
  7. Security
    1. Your right to access the halifaxcreditchecker.co.uk website and the Halifax Credit Checker services is personal to you. You must not allow any other person to have access to your account on the halifaxcreditchecker.co.uk website or the Halifax Credit Checker services using your username and password. You must keep your username and password confidential.
    2. We reserve the right to suspend your access to the halifaxcreditchecker.co.uk website and the Halifax Credit Checker services if at any time we consider that there is or is likely to be a breach of security or your use of the halifaxcreditchecker.co.uk website is in any way detrimental to us or anyone else.
    3. We reserve the right to require you to change any or all of the passwords used by you in connection with the halifaxcreditchecker.co.uk website and/or the Halifax Credit Checker services
  8. Copyright, trade marks and other intellectual property rights
    1. You acknowledge and agree that all copyright, trade marks and all other intellectual property rights in the halifaxcreditchecker.co.uk website and Halifax Credit Checker services and all aspects of them are owned by us, Bank of Scotland plc those businesses who provide services to us as part of the Halifax Credit Checker services.
    2. You may take reasonable copies of the information or reports provided as part of the Halifax Credit Checker services solely for your own personal use. You may not use it on a commercial basis or provide it to anyone else. You may not sell it on, republish it, redistribute it, copy (except as permitted above) or adapt it.
  9. Our liability to you

    PLEASE READ THIS PARAGRAPH CAREFULLY AS IT EXPLAINS WHAT LIABILITY WE HAVE TO YOU AND WHAT EXCLUSIONS APPLY

    1. There are certain things which we agree we will not exclude or limit our liability to you for. These are:
      1. liability for death or personal injury caused by negligence;
      2. fraud or fraudulent misrepresentation; or
      3. any other liability which we cannot limit or exclude under law.
    2. Nothing in these terms and conditions affects any statutory rights you may have as a consumer.
    3. Subject to paragraph 9.4 below, if we breach these terms and conditions or are negligent in providing the Halifax Credit Checker services we will only be responsible for loss or damage that you suffer which is foreseeable; i.e. which is a likely result of our breach or negligence in providing the Halifax Credit Checker services. If the loss or damage is not foreseeable we cannot be responsible for it.
    4. We cannot be responsible to you for loss or damage or any other liability (whether it arises from breach of these terms and conditions or negligence) which is in excess of £100 for each incident.
  10. Data protection, cookies and privacy policy
    1. We will collect personal information in connection with your use of the Halifax Credit Checker services via the halifaxcreditchecker.co.uk website. Our privacy policy has details of what information we collect, what we do with that information, and any other related matters such as cookies. Our privacy policy forms part of these terms and conditions. Please also refer to paragraph 4.5 above regarding the requirement to transfer your information to CSID within the United States of America, or to C6, if you subscribe for Noddle Web Watch services.
    2. You agree that we can collect, use, transfer and disclose your personal information in accordance with our privacy policy, and you also agree to our use of cookies as described in our privacy policy. To view our privacy policy please click here.
  11. How to contact us

  12. Hyperlinks to other websites
    1. To provide increased value to you, we may provide links to other websites or resources for you to access. You can choose whether or not to access these links. As you will appreciate, once you have left our website we are not responsible for the availability or content of these external websites or resources. We do not review or endorse the content of these websites. If you provide your personal details to these external websites then the use of these personal details will be governed by the privacy policy of that website and not our privacy policy.
  13. Miscellaneous
    1. We shall be under no liability for any delay or failure to deliver the Halifax Credit Checker services or otherwise perform any obligation under these terms and conditions if the delay or failure is caused by circumstances beyond our reasonable control.
    2. If any portion of these terms and conditions is held by any competent authority (such as a court) to be invalid or unenforceable (either wholly or in part) the validity or enforceability of the other portions of these terms and conditions shall not be affected.
    3. These terms and conditions do not give any rights to anyone who is not a party to them.
    4. These terms and conditions and your use of the halifaxcreditchecker.co.uk website and Halifax Credit Checker services shall be governed by the laws of England and Wales and you agree to submit to the non-exclusive jurisdiction of the courts of England and Wales in relation to any disputes arising out of or in connection those matters.
