Noddle Terms and Conditions for Halifax Credit Checker

  1. THESE TERMS AND CONDITIONS
    1. What these Terms and Conditions cover: These Terms and Conditions are the terms on which we supply the Noddle services, Credit Coach services and the Premium Noddle services to you. They also apply to your use of the www.halifaxcreditchecker.co.uk website and the Noddle app. The Noddle services, Credit Coach services and Premium Noddle services are described in paragraph 9. These apply to you if you (i) have an eligible Halifax financial product and (ii) have been invited to register directly by Halifax.
    2. Why you should read them: Please read these terms carefully before you sign up for any of the Noddle services, Credit Coach services and (if relevant) Premium Noddle services. These terms tell you who we are, how we will provide services to you, how you and we may change or end the contract, what our liability to you is, what to do if there is a problem and other important information. If you think that there is a mistake in these terms or you think these terms require any changes, please contact us to discuss your concerns. By using the www.halifaxcreditchecker.co.uk website, the Noddle app or signing up for any of the Noddle services, Credit Coach services and/or Premium Noddle services you are entering into a contract with us on these Terms and Conditions.
    3. Who is the contract for the Noddle services between?: The contract for the Noddle services is between us and you. Neither Lloyds Bank plc or the Halifax are a party to this contract.

  2. INFORMATION ABOUT US AND HOW TO CONTACT US
    1. Who we are: ‘Noddle’ is a trading name of Callcredit Consumer Limited. Callcredit Consumer Limited operates this website and the Noddle app and will be providing the Noddle services, Credit Coach services and/or Premium Noddle services to you. Callcredit Consumer Limited is a company established in England and Wales. Its company number is 07891157, its VAT number is 974 8228 76 and its registered office is at One Park Lane, Leeds, West Yorkshire LS3 1EP. In these Terms and Conditions, "we", "us" and "our" therefore refers to Callcredit Consumer Limited.
    2. Authorisation: Callcredit Consumer Limited is authorised and regulated by the Financial Conduct Authority under number 737743. Authorisation can be checked on the Financial Services Register at https://register.fca.org.uk/
    3. What is the position if you signed up via one of our partners?: If you signed up to use Noddle through one of our partners then different Terms and Conditions may apply to your use of our site. You should have been provided with those Terms and Conditions when you signed up through one of our partners and you can also access these when you log in to your Halifax Credit Checker Noddle account.
    4. How to contact us: You can contact us by sending an email to us at halifaxcontact@noddle.co.uk. This contact email address can be used in relation to reporting any issues you have had in relation to concluding your contract for the Noddle services, Credit Coach services and Premium Noddle services with us or in relation to any of these services. Any concerns in relation to the content of your credit report should be raised with us as set out in paragraph 20.1.
    5. How we may contact you: If we have to contact you we may do so in a number of ways:
      1. by writing to you at the email address you have saved on your Halifax Credit Checker Noddle account; or
      2. by sending a text message to the mobile phone number you have saved on your Halifax Credit Checker Noddle account; or
      3. by sending you a notification on your mobile device via the Noddle app; or
      4. by calling you on the phone number you have saved on your Halifax Credit Checker Noddle account; or
      5. by any other communication method where you have given us the details to allow us to do so. Please ensure that you update your contact details on your Halifax Credit Checker Noddle account should any of these details change.
    6. Writing includes emails: When we use the words "writing" or "written" in these terms, this includes emails.

      PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS WEBSITE AND/OR THE NODDLE APP AND SIGNING UP FOR THE NODDLE SERVICES, CREDIT COACH SERVICES AND PREMIUM NODDLE SERVICES AS THEY CONTAIN LEGAL RIGHTS AND OBLIGATIONS.

  3. APPLICATION PROCESS FOR NODDLE SERVICES AND CREDIT COACH SERVICES AND OUR CONTRACT WITH YOU
    1. Process for making an application to receive the Noddle services:

      1. You need to apply online at www.halifaxcreditchecker.co.uk or download the Noddle app to your mobile device to create a Halifax Credit Checker Noddle account with us and receive the Noddle services. The Noddle services include the free for life credit report and credit score. More details of these Noddle services can be found in paragraph 9.1.
      2. Once you have completed our online application process you will see an onscreen message indicating whether your application has been successful. If your application is successful we will also send you an activation link to the email address you provide.
      3. In addition to the limitations in paragraph 7, you may only register for the Halifax Credit Checker website and use the Noddle services if you: (i) have an eligible Halifax financial product and (ii) have been invited to register directly by Halifax. By registering here, you are confirming that you meet these requirements. If you do not meet these requirements, you may register for Noddle services at noddle.co.uk.
    2. Activation Link: You must use the activation link we send you to activate your Halifax Credit Checker Noddle account within 24 hours of when we send it to you. If you don’t do this then you must go through the application process again. Once your account has been activated, you will receive welcome communications via one of the communication methods set out in paragraph 2.5 above.
    3. If your application is unsuccessful: Not everyone that applies for the Noddle services will be accepted as a user. We do not have to notify you why you have not been accepted but one reason for this may be that, at the time you make your application, we may have been unable to match your personal details to the correct credit report. You may also not have been accepted because you did not have enough of a credit history on your credit file to provide a credit report. If this is the case then you may be offered our Credit Coach service. Credit Coach gives you information on actions that you should consider taking to build up enough credit history for us to be able to provide a credit report and score to you in the future.
    4. When does the contract for the Noddle services come into existence? The contract in respect of the Noddle services will only come into existence between us once you have used the activation link to activate your Halifax Credit Checker Noddle account within the 24 hour period referred to in paragraph 3.2 above.
    5. Process for making an application to receive the Credit Coach services: You may be offered our Credit Coach service if your application for the Noddle services is unsuccessful as detailed in paragraph 3.3. Credit Coach gives you information on actions you should consider to build up enough credit history for Noddle to be able to provide a credit report and score to you in the future.
    6. When does the contract for the Credit Coach services come into existence? The contract in respect of the Credit Coach services will come into existence as detailed in paragraph 3.4.
    7. How to correct errors in the application process: If your application is successful but you have made a mistake to your personal details during the application process you can update some of these details in your Halifax Credit Checker Noddle account. If you are unable to update any of your personal details this way you should contact the Noddle team for assistance at Halifaxcontact@noddle.co.uk.

  4. APPLICATION PROCESS FOR PREMIUM NODDLE SERVICES AND OUR CONTRACT WITH YOU
    1. Process for making an application to receive Premium Noddle services:
      1. If you have been accepted as a user of the Noddle services, you will receive the following Premium Noddle services free of charge. Further details of each service are available in paragraphs 9.3 to 9.5 or by logging into your Halifax Credit Checker Noddle account:
        • Noddle Improve
      2. You also have the opportunity to purchase access to the following Premium Noddle service:
        • Noddle Web Watch
        • Noddle Alerts
      3. If you have been accepted as a user of the Credit Coach services, you may also purchase the Premium Noddle service called Noddle Web Watch. This service is not a free service and you have to pay for it. Further details of this service are available in paragraph 9.5 or by logging into your Halifax Credit Checker Noddle account.
      4. If you want to access any of the Premium Noddle services, or if you wish to purchase any Premium products which are not included free of charge as a user of the Halifax Credit Checker website, you should complete the sign up process once you have logged onto your Halifax Credit Checker Noddle account (and pay the applicable fee, if such Premium Noddle service is not included in your access). The details of the Premium Noddle services (and the fees for the Premium Noddle services to which you don’t have free of charge access) can be accessed via either your Halifax Credit Checker Noddle account homepage or the relevant product information pages once you are logged into your Halifax Credit Checker Noddle account. In respect of the Premium Noddle services to which you don’t have free of charge access, the fee for those Premium Noddle services must be paid before we will provide such applicable Premium Noddle services to you. You will need to make a payment for your one off 12 month fee via PayPal or our third party payment provider Data Cash, who will take payment from you automatically at this point.
      5. In respect of any Premium Noddle services to which you pay for, if your credit or debit card is declined, rejected or reversed: If your payment is declined, rejected or reversed and we do not receive the one off 12 month fee, we will be unable to provide the applicable Premium Noddle services you have ordered to you.
      6. When does the contract for the Premium Noddle services come into existence?: The contract in respect of the Premium Noddle services you have applied for will come into existence between us:
        1. 1. In respect of those Premium Noddle services to which you have free of charge access, as detailed in paragraph 3.4; and
        2. 2. In respect of those Premium Noddle services which you pay for, once we have received payment in full for the applicable one off 12 month fee. Payment will be confirmed to you via an on screen message, as detailed in paragraph 3.4. If you wish to continue to receive the Premium Noddle Services after the 12 month period has come to an end, you will need to provide payment as detailed in paragraph 4.4. Your contract in respect of the Noddle Premium services will not automatically renew.

  5. INFORMATION NEEDED TO PROVIDE THE NODDLE SERVICES, CREDIT COACH SERVICES AND THE PREMIUM NODDLE SERVICES
    1. Information needed and what will happen if you do not give us the required information: We need certain information from you as part of the application process so that we can supply the Noddle services, Credit Coach services and Premium Noddle services to you. If you do not give us this information within a reasonable time of us asking for it, or if you give us incomplete or incorrect information, we may end the contract (and paragraph 15 will apply). We will not be responsible for supplying the Noddle services, Credit Coach services and/or Premium Noddle services late or not supplying any part of them if this is caused by you not giving us the information we need within a reasonable time of us asking for it.
    2. Need for us to obtain credit report information: For us to be able to provide the Noddle services and/or Premium Noddle services to you we need to obtain your credit report information held in the credit reference database of our group company Callcredit Limited. By applying for the Noddle services and/or Premium Noddle services you agree that we can obtain and use your credit report information in this way.

  6. ACCESSING THE TERMS OF THE CONTRACT BETWEEN US
    1. You can access the terms of your contract with us for the applicable Noddle services, Credit Coach services and/or Premium Noddle services in the “My Products” tab of your Halifax Credit Checker Noddle account, in the footer of the Halifax Credit Checker website or in the menu of the Noddle app.

  7. LIMITATIONS ON APPLYING FOR AND RECEIVING THE NODDLE SERVICES, CREDIT COACH SERVICES AND PREMIUM NODDLE SERVICES
    1. We only make the Noddle services, Credit Coach services and Premium Noddle services available in the UK: Unfortunately, we do not accept applications for the Noddle services, Credit Coach services or for the Premium Noddle services or provide them to anyone who is not resident in the UK, the Channel Islands or the Isle of Man. Some elements of the Noddle services may not be available to residents outside of the UK mainland.
    2. Over 18s only: You may only apply for and use the Noddle services, Credit Coach services and/or Premium Noddle services if you are over 18 years of age. By registering on the Halifax Credit Checker website or the Noddle app and making an application for the Noddle services, Credit Coach services and/or Premium Noddle services you confirm that you are over 18 years of age.
    3. Noddle services, Credit Coach services and/or Premium Noddle services for personal use only: You may only use and access the Noddle services, Credit Coach services and/or Premium Noddle services, the Halifax Credit Checker website and the Noddle app on your own behalf, for your personal non-commercial use and not on behalf of anyone else. You cannot order credit information about anyone else from this website or via the Noddle app.

  8. CHANGES TO THESE TERMS AND CONDITIONS OR THE NODDLE SERVICES, CREDIT COACH SERVICES OR PREMIUM NODDLE SERVICES
    1. Minor changes to the Noddle services, Credit Coach services and/or Premium Noddle services: We may make minor changes to the Noddle services, Credit Coach services and/or Premium Noddle services to reflect changes in any relevant laws or regulatory requirements and/or to implement minor technical adjustments and improvements to the way we deliver the Noddle services, Credit Coach services and Premium Noddle services to you. These minor changes will not adversely affect your use of the Noddle services, Credit Coach services and/or Premium Noddle services in any significant way.
    2. More significant changes to the Noddle services, Credit Coach services and/or Premium Noddle services or to these Terms and Conditions: We may change these Terms and Conditions or make more significant changes to the Noddle services, Credit Coach services and/or Premium Noddle services than those set out above. If we do this we will notify you of the changes either by email or by a message when you next sign into your Halifax Credit Checker Noddle account. We will try to give you as much notice as we can of the proposed changes. We may be unable to give notice if we need to make any urgent changes.
    3. Cancellation of the Noddle services, Credit Coach services and/or Premium Noddle services: : If the changes we may make in paragraph 8.2 above are significant and adversely affect your use of the Noddle services, Credit Coach services and/or Premium Noddle services and as a result, you don’t want to continue to receive the Noddle services, Credit Coach services and/or Premium Noddle services affected by the changes, then you can cancel your contract with us by letting us know in writing by e-mail to Halifaxcontact@noddle.co.uk. If the changes are significant and adversely affect your use of a Premium Noddle service then we shall refund any charges paid by you in advance from the date on which you let us know that you want to cancel your contract with us."
  9. NODDLE SERVICES, CREDIT COACH SERVICES AND PREMIUM NODDLE SERVICES

    PLEASE READ THESE PARAGRAPHS CAREFULLY AS IT EXPLAINS WHAT THE NODDLE SERVICES ARE AND WHAT EXCLUSIONS APPLY. THERE ARE THREE TYPES OF NODDLE SERVICES: NODDLE SERVICES, CREDIT COACH SERVICES AND PREMIUM NODDLE SERVICES.

    1. Noddle services: Once we accept your application for the Noddle services, we agree to provide the following services to you for free under these Terms and Conditions. If you get the Credit Coach services set out at paragraph 9.2 below you will not get the Noddle services.
      1. Credit Report: TransUnion UK provides us with your credit file, which we will provide to you in the form of a credit report online. The credit report will be updated monthly. You will also receive a regular newsletter as part of this service (unless you have unsubscribed from it). If we are unable to match your personal details to a credit report because you do not have enough of a credit history, we may offer you our Credit Coach service (as described more fully in paragraphs 3.3 and 9.2).
      2. Credit Rating: An assessment of your credit rating will be available to you online. This rating will be based on your history of borrowing and repayment.
      3. Credit Score: We will provide your most recent credit score to you. Your credit score is an indicator of how good your credit history is and your likelihood of getting credit. This will be made available to you online. It will be updated when you sign in to Noddle but will only be recalculated if your credit report has been updated since the last time you signed in.
      4. Vouchers and Special Offers: You may be provided with money saving offers and vouchers online. These vouchers and offers are not provided by us but are instead provided by third parties. We cannot be held responsible for the content of services, vouchers or offers provided by these third parties and since these items are provided to you by these third parties you should be aware that additional Terms and Conditions may be imposed by these third parties.
    2. Credit Coach Services: Where you do not have enough credit history on your credit file to enable a credit report to be generated for you, we may offer you the Credit Coach service. The Credit Coach service gives you information on actions that you should consider taking to build up enough credit history for TransUnion UK to provide a credit file and score to you in the future. You may request a copy of your credit file based on the data TransUnion UK do hold at https://www.callcreditstatreport.co.uk/CreditReport. We will check the information you have provided us during sign-up every 90 days to see whether there is enough information to enable TransUnion UK to provide Noddle with your credit file and we will contact you if this is the case. This periodic check will leave a footprint on your credit file but this footprint will only be visible to TransUnion UK and neither lenders nor you will be able to see this on your credit file.
    3. Premium Noddle services - Noddle Improve services: If you have been accepted as a user of the Noddle Improve services, we agree to provide the following services to you for the duration of your subscription to those services.
      1. We will identify the key things which are affecting your credit score and provide suggestions as to actions that you may wish to take to improve your credit score. These are simply suggestions and not specifically tailored and detailed advice. In addition, we cannot guarantee that if you take the actions that we suggest your credit score will be improved. Also you should be aware that it will take time for any action taken to affect your credit score.
      2. In addition to providing your most recent credit score as part of the Noddle service, we will provide you with online access to your credit score history. Your credit score history provides you with your previous monthly credit scores during the period of up to 6 months before your most recent credit score. Your credit score history helps you track any changes and spot any trends which may have occurred in your credit score during that period. You will not receive your credit score history for any period before you were accepted as a user of the Noddle Improve services and you will not receive any credit scores for months in which you did not log into your Halifax Credit Checker Noddle account. You will not receive your credit score history unless you apply, and are accepted, for the Noddle Improve services (which is one of our Premium Noddle services).
    4. Premium Noddle services - Noddle Alerts services: If you have subscribed to the Noddle Alerts services, we agree to provide the following services to you for the duration of your subscription to those services.
      1. If there have been any significant changes to your credit report/score, we will send an alert by email to the email address saved on your Halifax Credit Checker Noddle account. It is your responsibility to ensure the email address we hold for you is up to date. The email will contain details of any alerts that have been triggered on your credit report. If no alerts have been triggered we will not send you an email. However, we will send you an email on a monthly basis to confirm that we are continuing to monitor your file and that no alerts have been received in this period.
      2. If you receive an email notifying you of any alerts on your file you should log into your account to obtain further detail of the alert. On logging in to your Halifax Credit Checker Noddle account, you will be able to view further details of the alert. It is your responsibility to log into your account to get further detail of the alert.
      3. Noddle Alerts is a notification only service. You are responsible for taking action in relation to the alert and logging into your account to get further detail of the alert. We will not take any action other than notifying you of the alert.
      4. You should not rely solely on the Noddle Alerts service to ensure that your credit report is up to date. It is your responsibility to regularly check your credit report to ensure that the information recorded in it is accurate and up to date.
    5. Premium Noddle services - Noddle Web Watch services: If you have been accepted as a user of the Noddle Web Watch services, we agree to provide the following services to you for the duration of your subscription to those services. We are unable to offer this service unless you have provided all of your details to us that we have requested. Also, it is important for this service in particular that you keep your details up to date.
      1. Noddle Web Watch is a service provided by Mergermarket Limited (C6). If we receive details from C6 that your personal data is being traded or being sold fraudulently on the Internet, chat rooms, bulletin boards and file sharing sites, we will send you an email to the email address saved on your Halifax Credit Checker Noddle account, advising you that we have received an alert from C6. It is your responsibility to ensure the email address we hold for you is up to date. On receiving the email you will be able to log in to your Halifax Credit Checker Noddle account to obtain further detail of the Noddle Web Watch alert. If there have been no alerts triggered then we will not send you an email. However, we will send you an email on a monthly basis to confirm that we are continuing to monitor your file and that no alerts have been received in this period.
      2. For us to be able to provide the Noddle Web Watch services to you, you will need to provide to us certain personal information (which we will request from you) that is to be monitored. It is very important that you provide accurate details to us. You agree that we can provide the information to C6, in order to provide the Noddle Web Watch services to you.
      3. You can update your information saved on your account as often as you like and monitoring will start instantly.
      4. Noddle Web Watch is a notification only service. You are responsible for taking action in relation to the alert and logging into your account to get further detail of the alert. We will not take any action other than notifying the alert to you. The general guidance given in relation to Noddle Web Watch services is not tailored to your specific circumstances. You should therefore consider your own specific circumstances in deciding what action to take in response to the alert.
      5. You should not rely solely on the Noddle Web Watch services to ensure that your personal data is not being used or disclosed unlawfully. The Noddle Web Watch services do not replace your responsibility to regularly check your financial information and credit report to ensure that the information recorded in it is accurate and up to date.

  10. AVAILABILITY OF NODDLE SERVICES, CREDIT COACH SERVICES AND/OR PREMIUM NODDLE SERVICES
    1. Whilst we will try to make sure that the Noddle services, Credit Coach services and/or Premium Noddle services are available for use as much as possible we cannot guarantee their availability. You will appreciate that we need to take the website, the Noddle app and the Noddle services, Credit Coach services and/or Premium Noddle services down from time to time for maintenance. We will try to do this at times when we are expecting low usage but cannot guarantee that this will be the case. If we have to suspend access to the Noddle services, Credit Coach services and/or Premium Noddle services for longer than 21 days in any calendar month period we will, in relation to any Premium Noddle services, return the amount of fees that were paid for the period that the relevant Premium Noddle services were suspended. You may also contact us to end the contract for the Premium Noddle services if we suspend them, or tell you we are going to suspend them, in each case for a period of more than 21 days in any calendar month and we will refund any fees you have paid in advance for the remaining part of the year for the Premium Noddle services.
    2. No software provider can fully guarantee that its website and/or content is completely virus and bug free, but you should be aware that we are committed to trying to make the Noddle services, Credit Coach services and/or Premium Noddle services as virus and bug free as we can and use suitable virus checking software in relation to these services, the Halifax Credit Checker website, the Noddle app and its content. You should, however, still use appropriate virus checking software on the devices you use to access the Halifax Credit Checker website, the Noddle app and the Noddle services, Credit Coach services and/or Premium Noddle services.

  11. ACCURACY OF INFORMATION WE PROVIDE
    1. It is important to us that the information we supply to you from TransUnion UK is as accurate as possible and they use reasonable efforts to verify its accuracy. We cannot guarantee that it is completely accurate, however. Also, as you will appreciate some of this information comes from other businesses and sources, such as the electoral roll, insurance companies or financial institutions. Neither TransUnion UK, C6 nor any other third parties used to provide the Noddle services, Credit Coach services and/or Premium Noddle services have any control over the content of such information and are not responsible if it turns out to be inaccurate. If you consider the information to be inaccurate please raise a query using the process in paragraph 20.1. You will appreciate that whilst some of the Noddle services, Credit Coach services and/or Premium Noddle services will provide information to you this is provided for your guidance and information only. The fact that you have a good credit score does not mean that a lender, credit card company or other provider of financial services products will accept your application, and they have their own acceptance criteria. Also, your credit score does not take into consideration affordability issues which are also considered by financial services/credit providers.

  12. CHARGES FOR THE NODDLE SERVICES, CREDIT COACH SERVICES AND PREMIUM NODDLE SERVICES
    1. Noddle services and Credit Coach services provided free of charge: The Noddle services and Credit Coach services will be provided to you free of charge.
    2. Fees for Premium Noddle services: There may be a fee for the Premium Noddle services. Fee information is made available to you once you are logged into your Halifax Credit Checker Noddle account. This must be paid before we will provide the Premium Noddle services to you. This one off fee is charged for the following 12 month period and is inclusive of VAT. If we change the fee for the Premium Noddle services we will let you know what the increase is by email at least four weeks before the end of the 12 month period you have paid for. If you are unhappy with the increase you can choose not to renew. If you do not want to renew then you do not have to do anything: you can ignore our renewal request.
    3. Pricing Mistakes: It is always possible that, despite our best efforts, some of the Premium Noddle services we sell may be incorrectly priced. If we make a mistake in relation to the charges for the Premium Noddle services and notice this before actioning your application or renewal we will contact you for your instructions. If we accept and process your application where a pricing error is obvious and could reasonably have been recognised by you as a mispricing, we may end the contract and refund you any sums you have paid.

  13. DURATION OF NODDLE SERVICES, CREDIT COACH SERVICES AND PREMIUM NODDLE SERVICES
    1. When does your access to the Noddle services, Credit Coach services and/or Premium Noddle services start? Paragraph 3.4 makes it clear when your contract for the Noddle services begins. If your application is unsuccessful you may be offered our Credit Coach services as detailed in paragraph 3.3, and paragraph 4.3 makes it clear when the Premium Noddle services begin. You will be given access to the relevant Noddle services, Credit Coach services and/or Premium Noddle services on the Halifax Credit Checker website and/or via the Noddle app and you will start to receive those services from that point. You have a right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel your contract for these services if you change your mind. Further details of this cancellation right is set out in paragraph 14 below.
    2. Continuation of the Noddle services and Credit Coach services: We will automatically continue to provide the Noddle services and Credit Coach services until they are cancelled in the way set out below in paragraph 14 or paragraph 15. In order to continue the Premium Noddle services, you need to renew these each year in accordance with paragraph 13.3 below.
    3. How long will the Premium Noddle services be provided?: We will provide you with any Premium Noddle services for an initial 12 month period from when our contract with you for those services starts, and, after such period:
      1. 1. In respect of those Premium Noddle services which you pay for: At the end of this period we will let you know that the services are due for renewal. If you choose to renew and pay the 12 month fee, we will provide the Premium Noddle services for further 12 month periods. You can choose not to renew at the end of any of those periods. If you do not want to renew then you do not have to do anything: you can ignore our renewal request. Paragraphs 14 and 15 apply and set out when the Premium Noddle services can be cancelled by you or us.
      2. In respect of those Premium Noddle services which are included free of charge in your access: such Premium Noddle services will continue until (i) our agreement with Lloyds Bank plc comes to an end; or (ii) the Noddle services are cancelled by you or us in accordance with paragraphs 14 and 15; or (iii) you cease to be a Halifax Customer.
    4. If our agreement with Lloyds Bank plc comes to an end, or if you cease to be a Halifax customer:
      1. we will continue to provide you with the Noddle services and Credit Coach services (accessible via noddle.co.uk); and
      2. we will continue to provide you with any Premium Noddle services in accordance with paragraph 13.3.
  14. YOUR RIGHTS TO END THE CONTRACT WITH US
    1. How to cancel the Noddle services or Credit Coach services: If you no longer wish to receive any Noddle services or Credit Coach services, or wish to exercise your statutory right to be forgotten you may tell us to cancel them by sending a request specifying which services you no longer wish to receive by emailing us at Halifaxcontact@noddle.co.uk. We will administer this change within a reasonable time and this action will close your Halifax Credit Checker Noddle account.
    2. How to cancel the Premium Noddle services: If you have subscribed for any of the Premium Noddle services you may tell us to cancel any of those services at the points set out in paragraph 14.3 by sending a request specifying which services you no longer wish to receive by emailing us at Halifaxcontact@noddle.co.uk.
    3. When can I cancel the Premium Noddle services? You may cancel the Premium Noddle services as follows:
      1. where we have told you about an upcoming change to the Premium Noddle services or these Terms and Conditions which is significant and has an adverse effect on you and paragraph 8.3 gives you a right to cancel. In those circumstances you can cancel the relevant Premium Noddle service before the change takes effect;
      2. at any time where we have told you about an error in the price for the Premium Noddle services and you don’t want to proceed;
      3. at any time where we have done something significant in breach of our contract with you and we have not fixed this breach within a reasonable time;
      4. at renewal, by choosing not to renew your Premium Noddle services when they are due for renewal and this will be dealt with as set out in paragraph 13.3 above;
      5. 5. you can cancel the Premium Noddle services within 14 days after the day when the contract for the applicable Premium Noddle service starts. We have set out when the Premium Noddle services begin in paragraph 13.1. If you cancel within this 14 day period, we require you to email us at Halifaxcontact@noddle.co.uk. You are entitled to a refund of the amounts you have paid for those services but we will deduct an amount to cover the days of service you have received before the time we are informed of your decision to cancel. Please note that if you have purchased any of the Premium Noddle services before you cancel the service, then you will not get a refund. To meet this cancellation deadline, it is sufficient for you to send your cancellation email before the 14 day cancellation period has expired. We will pay the refund without undue delay and not later than 14 days after the day on which we are informed about your decision to cancel. The refund will be paid using the same means of payment as you used for the initial transaction and you will not incur any fees as a result of the refund.
    4. If you tell us that cancellation is a matter of urgency (e.g. if you think that someone has got access to your password) we will do our best to cancel your registration immediately.

  15. OUR RIGHTS TO END THE CONTRACT WITH YOU
    1. When we may end our contract with you: We may cancel your registration on the Halifax Credit Checker website or via the Noddle app and cancel your receipt of any of the Noddle services, Credit Coach services and/or Premium Noddle services:
      1. because of your misuse of the Noddle services, Credit Coach services and/or Premium Noddle services. Misuse of the Noddle services, Credit Coach services and/or Premium Noddle services means use of the Noddle services, Credit Coach services and/or Premium Noddle services in a way which is not permitted by these Terms and Conditions or where there is fraud or reasonable grounds to suspect fraud; or
      2. if we stop providing the Noddle services, Credit Coach services and/or Premium Noddle services (but we will return any fees you have paid in advance for any of the Premium Noddle services not provided). We will let you know at least one calendar month in advance of our stopping providing the Noddle services, Credit Coach services and/or Premium Noddle services or the Halifax credit Checker website and/or the Noddle app; or
      3. if any payment that you owe us is declined, rejected or reversed.
    2. 2. Please be aware that as the functionality of the Premium Noddle services relies on the provision of the Noddle services, if you or we cancel the Noddle services, you will no longer be able to receive the Premium Noddle services either.
    3. Refund only in limited circumstances: Except as set out in paragraphs 14 and 15, you are not entitled to any refund of any amounts you have paid for any Premium Noddle services as a result of a cancellation of those services.

  16. SECURITY
    1. Rights to access the Noddle services, Credit Coach services and/or Premium Noddle services, website and the Noddle app is personal to you: Your right to access the Noddle services, Credit Coach services and/or Premium Noddle services is personal to you. You must not allow any other person to have access to your Halifax Credit Checker Noddle account or the Noddle services, Credit Coach services and/or Premium Noddle services using your username and password. You must keep your username and password confidential.
    2. 2. Ability to suspend your access to the Noddle services, Credit Coach services and/or Premium Noddle services, website and the Noddle app:We reserve the right to suspend your access to the. Halifax Credit Checker website, the Noddle app and the Noddle services, Credit Coach services and/or Premium Noddle services if at any time we consider that there is or is likely to be a breach of security or your use of the Halifax Credit Checker website or the Noddle app is in any way detrimental to us or anyone else.
    3. Obligations to change passwords: We reserve the right to require you to change any or all of the passwords used by you in connection with Halifax Credit Checker website, the Noddle app and/or the Noddle services, Credit Coach services and/or Premium Noddle services.
  17. SECURITY
    1.   18. COPYRIGHT, TRADE MARKS AND OTHER INTELLECTUAL PROPERTY RIGHTS
    1. Your acknowledgement that we own copyright etc. in our website, the Noddle app and the Noddle services, Credit Coach services and Premium Noddle services: You acknowledge and agree that all copyright, trade marks and all other intellectual property rights in the Halifax Credit Checker website, the Noddle app, Noddle services, Credit Coach services, Premium Noddle services and all aspects of them are owned by us, those businesses who provide services to us as part of the Noddle services or those businesses who are providing the vouchers and special offers.
    2. Your ability to take copies: You may take reasonable copies of the information or reports provided as part of the Noddle services, Credit Coach services and/or Premium Noddle services solely for your own personal use. You may not use it on a commercial basis. You may not sell it on, republish it, redistribute it, copy (except as permitted above) or adapt it.
  19. OUR LIABILITY TO YOU
    PLEASE READ THIS PARAGRAPH CAREFULLY AS IT EXPLAINS WHAT LIABILITY WE HAVE TO YOU AND WHAT EXCLUSIONS APPLY
    1. When are we liable to you: If we do not comply with the terms of our contract with you or we do not use reasonable care and skill in providing the Noddle services, Credit Coach services and/or Premium Noddle services to you then we will be responsible for the loss and damage which is a foreseeable result of this breach. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.
    2. No liability where the loss or damage is not foreseeable: We are not responsible for any loss or damage which is not foreseeable.
    3. We are not liable for business losses: We only supply the Noddle services, Credit Coach services and/or Premium Noddle services for domestic and private use. If you use the Noddle services, Credit Coach services and/or Premium Noddle services for any commercial, business or re-sale purpose we will have no liability to you for any loss of profits, loss of or damage to reputation, loss of contracts, loss of opportunity, loss of business, loss or depletion of goodwill, increased overheads or administration expenses, management time, loss of savings.

  20. DATA PROTECTION, COOKIES AND PRIVACY NOTICE
    PLEASE READ THIS PARAGRAPH CAREFULLY AS IT EXPLAINS WHAT LIABILITY WE HAVE TO YOU AND WHAT EXCLUSIONS APPLY
    1. What personal information we collect and how we use it: We will collect personal information in connection with your use of the Noddle services, Credit Coach services and/or Premium Noddle services via the Halifax Credit Checker website and/or the Noddle app, as well as in connection with your general dealings with Noddle (such as surveys, user testing, research and session tracking). Our Privacy Notice (which can be accessed here has details of what information we collect, what we do with that information, and any other related matters such as cookies and pixels. We ask you to confirm that you have read the Privacy Notice. Please also refer to paragraph 9.5 above regarding the requirement to transfer your information to C6 if you subscribe for Noddle Web Watch services.

  21. QUERIES AND COMPLAINTS
    1. Queries in relation to your credit report information: In the event that there is an unexpected result in your credit report or you feel that the information is not correct you should raise a query by using the online process which can be accessed via your credit report. This will raise a dispute with the credit reference agency run by TransUnion UK.
    2. Complaints:
      How to complain: If you have any complaints in relation to the Noddle services, Credit Coach services and/or Premium Noddle services then please contact our customer services team at Halifaxcontact@noddle.co.uk.     3. Complaint Resolution: We have a complaint handling process, which includes alternative dispute resolution (a process where an independent body considers the facts of a dispute and seeks to resolve it without you having to go to court). If we have sent you our final response and you are not happy with how we have handled any complaint, you may want to contact the statutory alternative dispute resolution provider for financial services in the UK – the Financial Ombudsman Service. The Ombudsman will not charge you for making a complaint and if you are not satisfied with the outcome you can still bring legal proceedings.       • if you haven't agreed a price upfront, what you're asked to pay must be reasonable;
      • if you haven't agreed a time upfront, it must be carried out within a reasonable time.

  24. MISCELLANEOUS
    1. Circumstances beyond our control: We shall be under no liability for any delay or failure to deliver the Noddle services, Credit Coach services and/or Premium Noddle services or otherwise perform any obligation under these Terms and Conditions if the delay or failure is caused by circumstances beyond our reasonable control.
    2. What happens if a court finds any part of this contract to be illegal If a court finds part of this contract illegal, the rest will continue in full force because each of the paragraphs of these Terms and Conditions operates separately.
    3. No rights given to third parties: These Terms and Conditions do not give any rights to anyone who is not a party to them.
    4. Which law applies and where you can bring court action: These Terms and Conditions are governed by the law of England and Wales and you can bring legal proceedings in respect of the products in the courts of England and Wales. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
    5. Transfer of rights under this contract: We may transfer our rights and obligations under this contract to another organisation. We will contact you to let you know if we plan to do this. If you are unhappy with the transfer you may contact us to end the contract within four weeks of us telling you about it and we will refund you any payments you have made in advance for the Premium Noddle services not provided.
